Field Rental Agreement

1. Parties
This Field Rental Agreement (“Agreement”) is entered into between FTY Lab Canada (“FTY LAB”) and the individual or organization booking the rental (“Renter”).
2. Rental Description
FTY LAB agrees to provide temporary access to designated facility space (the “Premises”) for the date(s) and time(s) confirmed at booking. Rental details including area, date, time, and fees are confirmed via booking confirmation or invoice. Access is limited strictly to the confirmed rental period.
3. Fees & Payment
Full payment is due at the time of booking unless otherwise agreed in writing. FTY LAB reserves the right to cancel unpaid bookings. All payments are non-refundable except as expressly provided in this Agreement. FTY LAB uses third-party payment processors and is not responsible for processing errors or service interruptions.
4. Cancellation & Rescheduling
If the Renter cancels more than seventy-two (72) hours prior to rental, a credit may be issued at FTY LAB’s discretion. Cancellations within seventy-two (72) hours of rental or no-shows are non-refundable. FTY LAB may cancel due to unforeseen circumstances, in which case a refund or credit will be issued.
5. Use of Premises
The Premises may only be used for lawful recreational or training purposes. The Renter agrees to supervise all participants and ensure compliance with all FTY LAB policies. No metal cleats, food, beverages (other than sealed water bottles), decorations, balloons, confetti, signage, equipment attachments, or alterations to the Premises are permitted unless prior written approval is obtained from FTY LAB management. Unauthorized use may result in immediate termination of rental without refund.
6. No Event Use
Field rentals are limited strictly to recreational or training use. Birthdays, celebrations, corporate gatherings, tournaments, or organized events are not permitted under this Agreement and require a separate Event Agreement.
7. Supervision & Custody
Unless separately contracted, FTY LAB does not provide coaching, instruction, or supervision during field rentals. The Renter assumes full responsibility for supervision, conduct, and safety of all participants and spectators during the rental period.
8. Damage to Property
The Renter is responsible for any damage to the Premises, equipment, or facility caused by the Renter or participants during the rental period. FTY LAB may charge repair or replacement costs to the Renter.
9. Insurance (Organizations Only)
If the Renter is an organization, club, or corporate entity, FTY LAB may require proof of commercial general liability insurance naming FTY LAB as an additional insured. FTY LAB reserves the right to deny rental if proof is not provided when requested.
10. Waiver Requirement
All participants must have a valid FTY LAB Master Participation & Release Agreement on file prior to accessing the Premises. Failure to complete the required waiver may result in denial of entry without refund.
11. Indemnification
The Renter agrees to indemnify and hold harmless FTY LAB, its owners, directors, employees, contractors, and agents from any claims, damages, losses, or expenses arising out of the Renter’s use of the Premises, except to the extent caused by FTY LAB’s gross negligence.
12. Limitation of Liability
To the fullest extent permitted by law, FTY LAB shall not be liable for indirect, incidental, or consequential damages arising from the rental or use of the Premises.
13. Governing Law
This Agreement shall be governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein. The courts of Ontario shall have exclusive jurisdiction.
14. Amendments
FTY LAB reserves the right to amend this Agreement at any time. The version in effect at the time of booking shall apply.
15. Entire Agreement
This Agreement constitutes the entire understanding between the parties regarding field rental services and operates separately from membership, program, or event agreements.
16. Acknowledgment
By booking and paying for a field rental, the Renter acknowledges and agrees to the terms of this Agreement.
